Terms and Conditions for The Visit Sweden Travel Competition

A. General

A.1 The Visit Sweden Travel Competition (the “Competition”) is arranged by the Swedish company V.S. Visit Sweden, org.no: 556500-7621, with address at Box 3030, 103 61 Stockholm, Sweden (“Visit Sweden”) in cooperation with Destination Lofsdalen AB, Turistrådet Västsverige / West Sweden Tourist Board, Destination Småland and Västmanland Turism (“the Partners”).

A.2 The details of the Competition are set out under visitsweden.com/win-a-trip (the “Competition Details”).

A.3 By participating in the Competition, these terms and conditions (the “Terms and Conditions”) and the Competition Details are accepted.

B. Eligibility

B.1 The Competition is open to residents of the UK aged 18 or over. The Competition is not open to employees, including family members of employees, of Visit Sweden, the Partners, and their group companies, agents, suppliers, representatives, and advisors.

C. How to participate

C.1 The Competition is entered by completing and submitting the competition entry and the Enter competition form (the “Entry”), as described in the Competition Details. Only one Entry and email address per person is permitted.

C.2 Entries are accepted from and until the times set out in the Competition Details and will not be considered before or thereafter.

D. Participant Privacy

D.1 For further details on Visit Sweden’s processing of participants’ personal data, please see Visit Sweden’s Privacy Policy.

E. Winner and prize

E.1 Based on the Entry and the selection criteria set out in the Competition Details, a jury will choose a winner (the “Winner”) of the Competition.

E.2 The Winner will receive the prize set out in Competition Details (the “Prize”). The Prize is subject to availability at the discretion of Visit Sweden and excludes high seasons unless otherwise set out in the Competition Details.

E.3 For the Winner, the Prize is non-exchangeable, non-transferable, and not redeemable for cash or other prizes.

E.4 The Winner will be published on visitsweden.com/win-a-trip and notified by Visit Sweden via email. The Winner must respond to such email notification within 28 days and claim the Prize. To claim the Prize the Winner must agree to assign or licence all intellectual property rights in the Entry to Visit Sweden on terms to be provided. If the Winner does not respond to such e-mail notification within 28 days, the Winner’s Prize will be forfeited without any right to compensation and Visit Sweden will be entitled to select another Winner.

E.5 Visit Sweden retains the right to substitute the Prize with another prize of similar value in the event the original Prize offered is not available for any reason.

E.6 The Prize must be booked by the date set out in the Competition Details, or the Winner’s Prize will be forfeited without any right to compensation and Visit Sweden shall be entitled to select another Winner.

E.7 Visit Sweden may post information about and photos of the Winner on Visit Sweden’s social media accounts, in connection with other information about the Competition and the Prize.

F. Intellectual property

F.1 By entering the Competition each participant will grant Visit Sweden the irrevocable right to use their Entry and any other materials that they submit to Visit Sweden in connection with the Competition ("Materials") for the purposes of selecting Winners and all other purposes ancillary to that purpose. By entering the Competition and accepting the Prize, the Winner agrees that Visit Sweden shall be the exclusive owner of all rights including copyright in the Materials and agrees to assign or licence all intellectual property rights in the Materials to Visit Sweden on terms to be provided.

G. Limitation of liability

G.1 Visit Sweden does not exclude or limit its liability for personal injury or death caused by its negligence or for fraudulent misrepresentation or any other liability that may not, by law, be limited or excluded.

G.2 Visit Sweden accepts no liability in relation to a participant's participation (or inability to participate) in the Competition, including any use made by any of the Winners of (or inability to use) their respective Prizes, to the maximum extent permitted by law. Without prejudice to that general exclusion, and insofar as is permitted by law, Visit Sweden will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of Visit Sweden or that of its employees and Visit Sweden will not be liable for any loss of income, profits, sales or damage to reputation, incurred by any participants. Participants' statutory rights are not affected.

H. Miscellaneous

H.1 Visit Sweden will not compensate participation in the Competition. Nor will Visit Sweden compensate participants in the Competition for any disappointment or loss in relation thereto.

H.2 The Winner is responsible for any fees, taxes (e.g., winners’ tax) and other costs relating to the Prize and shall indemnify Visit Sweden for such fees, taxes and costs which may be charged to Visit Sweden.

H.3 The Winner must ensure that it has taken necessary measures to be able to enjoy the Prize, e.g., the Winner is responsible to ensure that it can present necessary travel documentation such as a valid passport, visa, and a vaccination certificate, and Visit Sweden will not be responsible for or compensate any lack of preparation with the Winner in this regard.

H.4 The Winner is responsible to ensure that it has a travel insurance or other accurate insurance protection to enjoy the Prize, and Visit Sweden will not be responsible for any costs resulting from the Winner's lack of insurance coverage in relation to the Prize.

H.5 Visit Sweden will not be responsible for any injury or damage to the Winner’s or any other person’s computer or other hardware or software relating to or resulting from participation in or downloading any materials in connection with the Competition.

H.6 Visit Sweden reserves the right to, at any time, modify or discontinue, temporarily or permanently, the Competition, with or without prior notice.

H.7 Visit Sweden shall not be liable for any failure to comply with its obligations if the failure is caused by events outside Visit Sweden’s reasonable control. Such events include, but are not limited to, weather conditions, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, pandemics, a supervening legislation, or any other circumstances amounting to force majeure.

H.8 The Competition and these Terms and Conditions together with the Competition Details are governed by Swedish law. Any dispute, controversy or claim shall be exclusively settled by The District Court of Stockholm unless mandatory consumer protection law or marketing law provides otherwise.
